SERVICE AGREEMENT
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS RELATING TO YOUR USE OF OUR WEBSITE AND OUR FEE-BASED PRODUCTS:
1. All information presented by JorgeCruise.com is for education purposes only. The material is not intended to be a substitute for medical counseling. The site is intended to help you make informed decisions about your diet and health. Before adhering to any of the information or recommendations presented throughout the JorgeCruise.com website and/or emails, please consult with your own physician or healthcare practitioner. If you have specific medical symptoms, consult your physician immediately. If any recommendations given in this program contradict your physician’s advice, be sure to consult him or her before proceeding. 2. GENERAL TERMS AND CONDITIONS: You agree to: (a) maintain all equipment necessary for your access to and use of JorgeCruise.com; (b) maintain the security of your user identification, password and other confidential information relating to your JorgeCruise.com account; (c) be responsible for all charges resulting from use of your JorgeCruise.com account, including unauthorized use prior to your notifying JorgeCruise.com of such use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address.
3. CHARGES: You agree to paying, using a valid credit card (or other form of payment which we may accept from time to time), the fixed and periodic charges and fees set forth on this website during the sales of coaching programs we conduct from time to time (such as the three or six payment plan).
4. REFUNDS: Refunds are done exclusively online and must be requested by midnight February 6th, 2011, 7 days after the first product release date. A full refund will be issued as long as an email request is sent to: billing@JorgeCruise.com by midnight February 6th, 2011. Include Name, Invoice number, digital receipt, phone number and any other relevant information for a complete refund. We will not process refunds under any circumstance after February 6th, 2011, our money back guarantee deadline.
5. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither JorgeCruise.com, Inc., nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of JorgeCruise.com, Inc. You hereby release and forever waive any and all claims you may have against JorgeCruise.com, Inc., its officers, directors, mentors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of JorgeCruise.com, Inc.
6. Notwithstanding the foregoing paragraph, the total liability of JorgeCruise.com, Inc. and its officers, directors, employees, mentors, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of JorgeCruise.com, Inc. are hereby excluded even if JorgeCruise.com, Inc. or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law.
7. NOTICE: JorgeCruise.com may deliver notice to you under this Agreement by means of electronic mail, a general notice on JorgeCruise.com or by written communication delivered by first class U. S. mail to your address on record in the Site's account information. You may give notice to JorgeCruise.com at any time via electronic mail to JorgeCruise.com or by letter delivered by first class postage prepaid U. S. mail or overnight courier to the following address: JorgeCruise.com, 2924 Emerson Street, Suite 200 San Diego, CA 92106
8. CLASS INFORMATION: Your first set of digital meal plans will be ready to download (to browser and print) January 10th, 2011 at 7:00 AM PST. It is your responsibility to email tech@jorgecruise.com with any questions or concerns regarding the program, login information, or technical issues that may arise.
As with any online class, there may be technical issues. We will work as fast as we can to get any unexpected issues corrected. It is recommended that you have high-speed Internet access to participate in this program. Please be sure you meet the technical requirements before joining. It is also recommended to NOT have an AOL or YAHOO email account to prevent our emails to you being blocked. We are not responsible for you not getting your emails. Please email tech@jorgecruise.com if you are not getting emails from us. You will be able to log in to the site at any time however without getting email prompts from us.
By using this site, you are deemed to have agreed to these terms and conditions of use. We reserve the right to modify them at any time. You should check these terms and conditions periodically for changes. By using this site after we post any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these terms and conditions of use, please do not use this site.
